No photography in 100m periphery of ghats at Kumbh: Allahabad HC
ALLAHABAD: The Allahabad high court has
directed the Kumbh Mela administration to ban
photography within 100m of bathing ghats at Sangam and in Mela
area. Hearing a writ filed by Aseem Kumar Rai, a high court lawyer,
a division bench comprising Justice Pradeep Kumar Singh Baghel
and Justice Pankaj Bhatia warned if the directive is violated,
legal action would be taken against erring persons.
The court also directed the counsel representing Kumbh Mela authority to apprise authorities of this order, who in turn will inform mediapersons, asking them not to show bathing pictures in print or electronic media.
The court took cognizance of bathing scenes of Kumbh published in a Hindi daily and took it on record. Besides, the court directed the counsel representing Kumbh Mela authority and central government to file replies in the matter and fixed April 4, 2019 as the next date of hearing.
The petitioner had moved the petition requesting the court to restrain mediapersons from taking photographs of bathing or telecasting them.
The petition cited a division bench judgment of this court in 2013, Hemant Kumar versus State of UP and others, wherein this court observed — The media advisory issued by the Mela Adhikari, Kumbh Mela, 2013, takes care of preserving religious culture and heritage and prohibits photography in violation of sentiments of people. We are of the view that Mela administration has given sufficient guidelines for prohibiting photography in the area that may hurt sentiments of people, especially at Sangam and within 100m of bathing areas of Ganga-Yamuna. The mela administration is, however, not taking sufficient care, to enforce these prohibitions, issued by itself.
